Terms of service

These terms govern the use of Event Calendar, the calendar publishing service at events.aico.swiss.

1. Who provides the service

Event Calendar is provided by AICONOMY AG, Sägewiesenstrasse 10, CH-9325 Roggwil, Switzerland, registered in the commercial register of the Canton of Thurgau under VAT / UID CHE-466.130.799 and legally represented by Müller Mathias, Administrator (“we”, “us”). You can reach us at office@aico.swiss. TODO(vlad) The Impressum at aico.swiss publishes a different street and a lower-case company name, and “Administrator” is most likely the English rendering of Verwaltungsrat — the exact register wording, including signing authority, should replace it. See section 1 of the privacy policy.

2. Two kinds of user

Both are bound by these terms to the extent they apply; most of what follows is addressed to organizers, because they are the ones who publish.

3. What you may use it for

You may not use Event Calendar to:

We may suspend or remove a calendar, an account or a feed that breaches this section, and will say why when we do.

4. Your content stays yours

Fixtures, descriptions, logos and everything else an organizer puts into Event Calendar remain that organizer’s. You grant us only the permission we need to run the service: to store that content, and to publish it on the pages, feeds, embeds and notifications you have asked us to publish it on. We do not sell it and we do not use it to advertise to anyone.

5. Your responsibilities as an organizer

6. Availability, and what we do not promise

We work to keep the service running and correct, but it is provided as is. We do not warrant that it will be uninterrupted or error-free, and we do not guarantee that a third-party calendar application will fetch a feed, or deliver a notification, at any particular moment — that part is not ours to promise. Planned maintenance and breaking changes will be announced in advance to organizers where we reasonably can.

TODO(vlad) If a service level (uptime target, support response times) has been agreed with AICO customers, state it here or link the agreement that does.

7. Liability

To the extent permitted by law, we are not liable for indirect or consequential loss, lost profit, lost data, or for anything arising from a missed, late or incorrect event notification. Nothing here limits liability for intent or gross negligence, or any liability that cannot be limited by law. TODO(vlad) AICONOMY AG’s legal owner should confirm this clause and whether a liability cap applies.

8. Price and term

TODO(vlad) Commercial terms — price, billing period, notice period for termination — are not settled in this document. State them here, or reference the AICO platform agreement that governs them.

An organizer may stop using the service at any time. On termination we delete the account’s calendars, events and subscriber records; published feed URLs stop resolving.

9. Changes to these terms

We may update these terms. The date at the foot of this page always says when it last changed, and material changes will be communicated to organizers before they take effect.

10. Governing law

TODO(vlad) Governing law and place of jurisdiction are not stated in the aico.swiss impressum and have therefore not been asserted here. Swiss law with venue at the seat of AICONOMY AG in Roggwil TG is the expected answer; it needs confirming rather than assuming.
